On September 26, 2023, Gov. Gavin Newsome signed AB 732, which went into effect January 1, 2024. AB 732 states that local law enforcement agencies shall take steps to verify that individuals who have been prohibited from possessing firearms for the reasons listed below are no long in possession of firearms.

FAQ’s

1) How does someone get one the Prohibited Arms Persons File?

            * Any of the following can put you on the Armed Prohibited Persons list:

                        * Conviction of a felony or specified misdemeanor

                        * Mental health prohibition

                        * Restraining Order

                        * Domestic Violence conviction

                        * Condition of probation

                        * Felony wants or warrants

                        * Juvenile prohibition

Prohibition includes owning, purchasing, receiving, or possessing, or having under their custody or control, any firearms, ammunition, and ammunition feeding devices, including, but not limited to, magazines  for specified periods of time.

2) How do I become compliant?

If there are firearms in possession:

* Designee - The subject may name a designee and grant the designee power of attorney for the purpose of transferring or disposing of any firearms. The designee shall be either a local law enforcement agency or a consenting third party who is not prohibited from possessing firearms under state or federal law. The designee shall, within the time periods specified in subdivisions (d) and (e), surrender the firearms to the control of a local law enforcement agency, sell the firearms to a licensed firearms dealer, or transfer the firearms for storage to a firearms dealer pursuant to Section 29830.

* Local LEO – The subject may surrender the firearm(s) to the control of a local law enforcement agency for storage. Fees relating to administrative and/or storage may apply pursuant to Section 33880.

* Licensed firearms dealer (selling or storage) – The subject may surrender firearm(s) to a licensed firearms dealer for storage or sale.

 

If there are no firearms in possession:

*The subject will submit the completed Prohibited Persons Relinquishment Form, with a statement affirming that they have no firearms to be relinquished.

Upon completion of the form, turn it in to your probation officer or take to courthouse.
